Erie man, 29, sentenced to 5 years in federal prison for online child porn

A 29-year-old Erie resident who pleaded guilty to receiving child pornography via his cell phone and computer has been sentenced to the mandatory minimum penalty in his case - five years in federal prison.

The defendant, David Lyons, was also sentenced on Monday in U.S. District Court in Erie to 10 years of supervised release and ordered to pay $37,000 in restitution to the victims, the U.S. Attorney's Office in Erie said.

Senior U.S. District Judge David S. Cercone imposed the sentence, which followed the terms of a plea deal between the defense and the U.S. Attorney's Office in Erie, according to court records. Without the plea deal, Lyons would have faced a prison sentence of up to 20 years and a maximum of lifetime placement on supervised release.

Lyons was indicted in June 2020 and pleaded guilty in June to one felony count of receiving digital images of child pornography from January 2019 to March 2020, according to court records. As part of the plea deal, the government dropped a felony count that Lyons possessed the child pornography during the same time period.

The restitution is meant to compensate the victims depicted in the child pornography that Lyons received.

Lyons had been free on an unsecured bond of $10,000 while he awaited sentencing.
